Gwinnett County Police Officer James Stoudenmire has been placed on administrative leave following his Saturday DUI arrest.
According to this report from the Atlanta Journal Constitution, Stoudenmire caused an accident while leaving Wild Bill’s on Pleasant Hill Road. He rear ended another vehicle at a red light.
Following the accident, the police were called and noticed Stoudenmire appeared to be under the influence. The responding officer reportedly smelled alcohol on the off duty officer’s breath and noticed he was unsteady.
Signs like this, alcohol on the breath and swaying or stumbling are often used by the police in determining if a driver has been drinking.
Stoudenmire was arrested and charged with DUI and following too closely. The police report indicates that while being released, he stumbled into the wall. He was being held on a $1,557 bond.
This particular police officer claims he had 4 drinks between 4pm and 1am, when the accident occurred. Although anything is possible, 4 drinks in a 8 hour period typically doesn’t lead to intoxication like this.
We often think the only people accused of crimes are those who fit the “criminal” profile. DUI cases in particular are criminal offenses that tend to ensnare otherwise responsible citizens. We are all human and we all make mistakes.
Doctors, police, public officials, and neighbors are all subject to making mistakes like Stoudenmire’s. now, however, he must deal with the consequences of his actions. If this is his first DUI, those consequences could be jail time, community service hours, a Risk Reduction class, fines, license suspension, and possible probation.
Having an experienced Georgia DUI defense attorney on his side at trial could make all the difference in the world.
